What are the "Mentions Légales" on a web site in France?

All professional web sites in France (whether or not you sell products or services online) need to have the so called ‘Mentions Légales’ on it.

The website Service-Public Pro is the official website of the French administration, where you can find all sorts of intereresting information; including the below list on the subject of the "Mentions Légales". But what information should be in them?

Below a list of what information you need to provide: 

  • for an individual entrepreneur: name, first name, domicile
  • for a corporation: business name, legal form, address of the establishment or headquarters (and not a simple postal box), amount of social capital
  • e-mail address and phone number
  • for a business: registration number at the register of commerce and des sociétés (RCS)
  • for a craft activity: registration number in the Répertoire des Métiers (RM)
  • individual tax identification number: numéro de TVA intracommunautaire
  • for a regulated profession: reference to the professional rules applicable and the professional title
  • name and address of the authority having issued the authorization to exercise when it is necessary
  • name of the manager of the publication
  • coordinates of the web hosting company: name, business name, address and phone number
  • for a merchant site, general conditions of sale (CGV): price (expressed in euros and inclusive of VAT), fees and delivery date, method of payment, customer service, right of withdrawal, duration of the offer, cost of the technique of communication
  • CNIL number, in the case of collection of data on clients, read more on the CNIL here.

If you use cookies on your site, for example to collect data on visitiors behaviour, you must:

  • inform surfers of the purpose of the cookies
  • obtain their consent
  • provide users a way to deny it

The period of validity of consent is 13 months. Some cookies are however exempted from the collection of this consent.

The breach of such obligations may be punished up to one year of imprisonment, €75 000 fine for individuals and €375 000 for legal persons.
